Parties to Adoption

Who May Adopt
Citation: Ann. Code § 36-1-115

Any person over age 18 who has been a resident for at least 6 months may adopt, with the following stipulations:
  • Spouses must petition jointly.
  • Foster parents are given first preference on adopting their foster child.
Who May Be Adopted
Citation: Ann. Code § 36-1-115

Any person may be adopted.

Who May Place a Child for Adoption
Citation: Ann. Code § 36-1-108

Only the following may place a child for adoption:
  • The child's parent
  • The department
  • A licensed child-placing agency
  • A licensed clinical social worker
