Statute: Soc. Serv. §§ 371(10); 374(2); Dom. Rel. § 115-a

  • Only an authorized agency, birth parent, relative, or legal guardian may place a child for adoption.
  • Provisions related to a child brought into the State from outside the U.S. for private-placement adoption:

    • The written application shall include the names and addresses of the intermediaries, if any, through whom the adoptive parents learned of the existence and eligibility of the child. The preadoption investigation report shall include the compensation paid or agreed upon with respect to the placement of the child for adoption. No person may receive any compensation in connection with placing a child for adoption or for assisting a parent in arranging the placement of a child for adoption, except for an authorized agency. This section applies to any adoptive placement activity involving a child born in New York State, brought into the State, or involving a New York resident seeking to bring a child into the State for the purpose of adoption.
