- A licensed hospital that operates an emergency department
- A licensed adoption agency
- Does not include the offices of private physicians or dentists unless such individual voluntarily assumes responsibility for the child
- A licensed hospital that operates an emergency department
Responsibilities of the Safe Haven Provider
Statute: §§ 43-15-201; 43-15-203- Perform any act necessary to protect the physical health and safety of the child
- Notify the department
Immunity for the Provider
Statute: § 43-15-209

- Relinquishment to a safe haven is an affirmative defense to prosecution for abandonment, neglect, or exposure of the child.
