Infant Safe Haven Laws

Infant’s Age

Statute: § 13-3623.01

  • 72 hours or younger

Who May Relinquish the Infant

Statute: § 13-3623.01

  • Parent
  • An agent of the parent

Who May Receive the Infant

Statute: § 13-3623.01

  • Firefighters on duty
  • Emergency medical technician on duty
  • Staff member at a health care institution
  • Staff member at a private child welfare agency, licensed adoption agency, or a church

Responsibilities of the Safe Haven Provider

Statute: § 13-3623.01

  • Notify child protective services as soon as practicable
  • Offer written information about information and referral organizations

Immunity for the Provider

Yes

Protection for Relinquishing Parent

Statute: § 13-3623.01

  • The parent may remain anonymous and is not required to answer any questions.
  • A person is not guilty of abuse for leaving an infant with a safe haven provider.
